Idaho law note (August 12, 2026): Idaho Medicaid estate recovery can affect benefits paid for a member over age 55 and benefits paid for a permanently institutionalized member of any age. Federal protections bar recovery during a surviving spouse’s lifetime and from a surviving child under 21 or a child who is blind or permanently disabled; service type, capitation, liens, hardship, trusts, and probate facts still require review.
