Nevada law note (August 12, 2026): Nevada’s affidavit procedure may be used 40 days after death when there is no Nevada real property or interest in real property and the other conditions in NRS 146.080 are met. The current affidavit limit is $150,000 for a surviving spouse and $25,000 for another claimant. A separate court set-aside process can apply to some estates up to $150,000.
