Washington law note (August 12, 2026): Washington’s small-estate affidavit may be available 40 days after death for qualifying personal property when the probate estate subject to the procedure is $100,000 or less and the other conditions in RCW 11.62.010 are met. Real property, disputes, creditor issues, or a pending probate can require a different procedure.
